Motor Company Astana-Motors LLP (hereinafter, "Motor Company Astana-Motors LLP" or "we") respects your (also, the "User") right to privacy, and undertakes to protect your personal information (hereinafter, the "Personal Information"). Motor Company Astana-Motors LLP guarantees the legality of the means and measures used to ensure the security of Personal Information, and uses it only for the purposes specified in this Privacy Policy (hereinafter, the "Policy").

This Policy explains how we collect, use, store, and transfer Personal Information, including personal data.

By using this website https://astana-motors.kz (hereinafter, the "Website"), you express your consent to the Policy, and voluntarily and in your own interests, give consent to the following methods of processing Personal Information: collection, recording, systematization, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction for the purposes established by this Policy, with or without automation tools, at our discretion. If you disagree with the terms of the Privacy Policy, you shall stop using the Website.

Users aged:

• under 14 (fourteen) shall immediately stop using the Website on their own;
• 14 (fourteen) to 18 (eighteen) shall read the Policy together with their parent(s) and/or other legal representative(s).

This Policy may be amended at any time without prior notice to the User as may be necessary, or in accordance with the requirements of the current legislation of the Republic of Kazakhstan. The User shall be solely responsible for being aware of the updated terms of the Policy.

2. Purposes of Personal Information Collection

2.1. Personal Information shall be collected and used to:

• Identify you as a User, and, while using the Website, to conclude transactions, submit applications, requests, send work orders, etc.;
• Perform our contractual obligations to you;
• Provide you with access to the Website’s resources (services);
• Establish feedback with you, including phone calls, notifications (including, but not limited to, SMS, WhatsApp, Telegram, and otherwise), requests regarding the use of the Website, provision of services, process inquiries and applications, send promotional information about promotions and other services (updates, prices, special offerings);

• Verify the accuracy and completeness of the provided Personal Information;

3. List of Personal Information

3.1. We collect:

• Technical information automatically collected by software during your visit to the Website;
• Personal Information provided by you when filling out the relevant form, or information received by Motor Company Astana-Motors LLP through direct contact with the User, or from open sources (public resources, social networks, etc.);
• Other information provided at your discretion or obtained from public sources.

3.2. Technical Information.
When you visit the Website, the Website administration shall automatically gain access to information from standard server logs, namely:

• Your computer’s IP address (or proxy server, if used to access the Internet);
• Internet service provider;
• Domain name;

We consider the following to be your Personal Information:

• Last name, first name, patronymic (if any);
• Date and place of birth;
• Gender;
• Nationality;
• Individual identification number;
• Contact details: address of permanent registration, address of temporary registration, contact phone numbers, email;
• Identity document details: name, number, issue date, validity period, issuing authority;
• Credit and debit card numbers, as well as bank accounts and other payment information;
• Image (photograph);
• Information about electronic digital signature;
• Records of User requests to the contact center, User correspondence with us on the Website (feedback);
• Vehicle registration document details: name, number, date and issuing authority, state registration number, seating capacity, year of manufacture, engine volume, etc.;

Driving license details: name, number, date and issuing authority, validity period, driving category.

3.5. For the purpose of concluding contracts, the User may also provide the following personal data about the organization on whose behalf they are acting: last name, first name, patronymic (if any), position of the head, name, BIN, bank account number, registration number with justice authorities, registration address and postal address of such organization, corporate phone number, servicing bank, BIC and correspondent account. The specified information about the organization shall not constitute personal data.

3.6. If an individual acts as an individual entrepreneur or on their behalf, at the request or with the direct written consent of such individual entrepreneur, the following may additionally be provided: the individual entrepreneur’s last name and initials, tax identification number, correspondence address, phone number, bank account number, servicing bank, BIC, and correspondent account.
3.7. The software may also collect information about your photos, publications, other publicly available data on the User’s pages in public sources, data about people, social media pages, hashtags, comments, reviews, groups, communities, events, related people, etc.

4. Obligations of the Parties

4.1. Each User shall:

• Provide personal data required to conclude a transaction (contract, application, work order, or other form) with us, test drive, feedback, or other purposes specified in Section 2 of the Policy.
• Update and supplement the provided personal data as soon as possible (no later than 10 (ten) calendar days) after this information changes. In case of failure to notify or untimely notification by the User about changes in personal data, Motor Company Astana-Motors LLP shall not be liable for any adverse consequences resulting from such failure or untimely notification.

4.2. We shall:

• Use the received Personal Information exclusively for the purposes specified in this Policy.
• Ensure the storage of Personal Information, and never disclose it to third parties and/or authorized bodies, unless the User gives their written consent to such disclosure or otherwise prescribed by law;
• Take precautions to protect the confidentiality of the User’s Personal Information in accordance with the procedure commonly used to protect such information in existing business practices.
• Destroy Personal Information related to the respective User from the moment of their request, inquiry, or the request of the User’s legal representative or an authorized body for the protection of personal data subjects’ rights for the duration of an audit, in case of detection of inaccurate Personal Information or unlawful actions, as well as upon expiration of the Personal Information storage period.

5. Methods of Obtaining Personal Information. Protection of Personal Information

5.1. We collect Personal Information in the following ways:

• directly from the User or their authorized representatives;

from other sources, including, but not limited to, publicly available databases; partners in joint marketing and/or financial and economic activities; banks, insurance companies and/or other financial organizations with which we or you have contractual relations; mobile operators; social platforms; User friends or other persons connected with them through social platforms. Provided that the consent to provide Personal Information, specified to the owners/operators of the personal data database, includes a condition for transfer to third parties, and their receipt does not contradict the purposes of this Policy.

5.2. We shall take all necessary and sufficient organizational and technical precautions to protect Users’ Personal Information. Personal Information shall be available only to those employees who need it to perform their job duties.

5.3. Users shall acknowledge that third parties may gain unauthorized access to Personal Information in case of their negligence towards the secure storage of Personal Information and/or other information providing access to it. Neither Motor Company Astana-Motors LLP, nor any of the companies included in its structure, shall be liable for damages and losses (including lost profits) caused by such access. We recommend that you use strong passwords consisting of numbers, letters, and special characters for all your accounts.

5.4. We strongly urge you to be vigilant and take all necessary measures to ensure the security of your Personal Information, including anti-fraud and anti-phishing measures.

5.5. Your Personal Information shall be protected in strict accordance with the Law of the Republic of Kazakhstan dated 21 May 2013, No. 94-V on Personal Data and Their Protection, the Rules for the Implementation of Measures for the Protection of Personal Data by the Owner and/or Operator, as well as a Third Party, approved by Order of the Minister of Digital Development, Innovations and Aerospace Industry of the Republic of Kazakhstan dated 12 June 2023, No. 179/НҚ) and the internal regulatory documents of Motor Company Astana-Motors LLP. In addition, Motor Company Astana-Motors LLP shall take all necessary measures to make sure that the Partners of Motor Company Astana-Motors LLP and third parties to whom your Personal Information is transferred ensure its safety and protection in accordance with the current legislation of the Republic of Kazakhstan.

5.6. Personal Information (personal data) shall be destroyed in accordance with our internal regulations and the current legislation of the Republic of Kazakhstan.

6. Access to Personal Information

6.1. Access to the User’s Personal Information may be obtained by the following persons in addition to Motor Company Astana-Motors LLP (represented by their employees):

• any affiliated, related natural and/or legal persons, as well as subsidiaries of Motor Company Astana-Motors LLP;
• manufacturers of goods (cars, spare parts, accessories, and others) sold by Motor Company Astana-Motors LLP, as well as their authorized representatives;
• third parties, to achieve the purposes specified in Section 2 of this Policy. Such persons may include but are not limited to banks, insurance companies, and other financial institutions; owners of websites and applications that provide us with services related to placing and displaying advertisements on websites, in programs, products, or services owned by such persons; advertisers and/or advertising distributors, telecommunication operators, and other companies with whom we have contractual relationships providing for access to Personal Information, auditors/auditing companies.

6.2. Users’ Personal Information may also be transferred to:

• third parties to whom rights or obligations have been assigned, or by way of novation under the relevant agreement;
• any Kazakhstani and/or international regulatory body, law enforcement agencies, executive authorities, other official or state bodies, or courts, to which Motor Company Astana-Motors LLP is obliged to provide information in accordance with the current legislation of the Republic of Kazakhstan upon relevant request;
• third parties, if you have consented to the transfer of your Personal Information or if the transfer of Personal Information is required to provide you with the relevant product, service, work, or to perform a specific agreement or contract concluded with you;

7. Consent to Policy and Transfer of Personal Information

Users shall provide consent to the collection, processing, storage, and transfer of their Personal Information to third parties (under the terms of this Policy) by clicking the "Next" and/or "Agree" button on the Website, including when filling out a form requiring Personal Information, or in response to an informational message, whereby Users accede to this Policy and give their consent to the collection, processing, storage, and transfer of their Personal Information to third parties, respectively.

8. Withdrawal of Consent for Collection and Processing of Personal Information

8.1. Users have the right to withdraw their consent to the collection and processing of their Personal Information by Motor Company Astana-Motors LLP provided there are no outstanding obligations undertaken in accordance with the Policy, User Agreement, or any other contract/agreement with us. 8.3. Within 1 (one) business day from the receipt of the specified withdrawal, Motor Company Astana-Motors LLP shall cease collection, processing, and use of the relevant User’s data by excludingthe User from the list of Users. Within 3 (three) business days, Motor Company Astana-Motors LLP shall delete the User’s account and destroy the User’s Personal Information and/or biometric data.

8.4. Users have the right to withdraw their consent to receive promotional messages from Motor Company Astana-Motors LLP and/or partners of Motor Company Astana-Motors LLP. The withdrawal must be in writing and sent by registered mail or courier to: Head Office of MC Astana-Motors: 263 Rozybakiev Str., Almaty, or to email: office@astana-motors.kz.
Within 3 (three) business days from the receipt of the specified withdrawal, Motor Company Astana-Motors LLP shall cease sending promotional messages to the User by excluding them from the list of Users receiving promotional messages.

9. Final Provisions

9.1. We will store your Personal Information for as long as necessary to achieve the purpose for which it was collected, or to comply with the requirements of the legislation of the Republic of Kazakhstan.

9.2. The Privacy Policy shall not apply to procedures for ensuring the confidentiality of personal data and information, as well as to other procedures of third parties, including third parties providing the activities of third-party websites linked on the Website, and we shall not be liable for the confidentiality of user information on third-party websites. The inclusion of links to third-party websites on the Website shall not imply endorsement of such websites by us or our Partners.

9.3. Motor Company Astana-Motors LLP shall not be liable for the policies of collection, use, and disclosure of information (including data protection procedures) of other companies, such as Facebook, Apple, Google, Microsoft, Meta, and any other application developers, application providers, social media platform service providers, operating system providers, wireless service providers, and device manufacturers, including Personal Data disclosed by our users to other organizations through Applications or our social media (or in connection therewith).

9.4. By using the Website, you agree that we may place cookies on your device, store and access cookies, IP addresses, and use other methods to collect data about Website usage to improve your Website experience.
